ANC SERVES A LETTER OF DEMAND ON A NEW PARTY OBJECTING TO THE USE
AND REGISTRATION OF THE NAME, CONGRESS OF THE PEOPLE.
The African National Congress has served a letter of demand on a new
political party objecting to the use and registration of the name,
CONGRESS OF THE PEOPLE.
The letter of demand was also copied to the Independent Electoral
Commission, which the ANC will be obliged to join in any High Court
proceedings in light of the interim order issued on 31 October 2008 by
Judge Bertelsmann in the case of the African National Congress vs Mr
Mbhazima Shilowa, Mr Mosiuoa Lekota and Mr Mluleki George.
The CONGRESS OF THE PEOPLE was an idea of Professor ZK Matthews, an
ANC leader, which was adopted by the ANC Conference in 1953. It was
decided that the ANC together with its allies, the South African Indian
Congress, the Congress of Democrats and the Coloured Peoples Congress
would embark on a door-to-door campaign and invite the people of South
Africa to express their grievances so they could be addressed in a
common document.
The CONGRESS OF THE PEOPLE was a dramatic and historic event which took
place over two days (on 25 and 26 June 1955) near Kliptown in
Johannesburg. The other organisations that were involved were
subsequently amalgamated into the ANC or ceased to exist.
Since 1955 the ANC has continued to make regular use of the name in
various different ways. In many political circles and amongst its
supporters is commonly referred to as the “CONGRESS OF THE PEOPLE” and
or KHONGOLOSE WABANTU in Nguni, which demonstrate close present
association between the ANC and this name and concept.
The ANC enjoys significant common law rights in and to the name
CONGRESS OF THE PEOPLE. The use of this name by any other party is
likely to confuse a significant number of the electorate into believing
that such a party is the ANC or is associated or endorsed by the ANC,
which is, in fact, not the case.
It is apparent that the choice of this name is not a coincidence,
considering the previous attempt to adopt the names South African
National Congress or South African National Convention and or SANC by
the new party. It was and is a deliberate attempt to create a
connection and association with the ANC and an event in history that is
inextricably linked to its goodwill. The adoption of a logo which
evokes and resembles the logo used by the ANC during the formulation
and adoption of the Freedom Charter underscores this.
The ANC demands that the new political party immediately:
a) agree to change the intended name and also the Section 21
company to one not incorporating or including the name CONGRESS OF THE
PEOPLE or any other names or marks which are confusingly or deceptively
similar to this name;
b) voluntary withdraw trademark applications numbers:
2008/26378-9 CONGRESS OF THE PEOPLE in classes 25 and 45;
c) undertake in writing not to make any use of the proposed
name CONGRESS OF THE PEOPLE or any other names or marks which are
confusingly or deceptively similar to this name, including as a trading
name or style, company name, trade mark or domain name, or in any other
manner without the ANC’s prior written authority;
d) undertake in writing never to distribute any promotional and
or advertising materials bearing the name CONGRESS OF THE PEOPLE or any
other names or marks which are confusingly or deceptively similar to
this name, in any manner without the ANC’s prior written authority; and
to
e) deliver-up to the ANC for destruction, all matter in their
possession or under their control bearing the name CONGRESS OF THE
PEOPLE or any other names or marks which are confusingly or deceptively
similar to the name CONGRESS OF THE PEOPLE.
The ANC has given the new party until Thursday, 20 November 2008 to
comply with these demands failing which it will proceed to institute
High Court proceedings for an urgent interdict.
The current ANC generation has a responsibility to history, and to
future generations, to preserve the symbols and political heritage of
the movement.

Mbheki and his goons have been running the country in a manner that favours their own agenda. Mbheki had his loyalists whom he worked and listened to and all the people that opposed that “were kicked out”. I wouldn’t be surprised that Mbheki has always been aware of this Shikota movement and he is just waiting in the middle to see to which side to settle with. Look at the counsellors who are resigning, their time is up and mostly have not delivered (but they want to stay in power and the only possible option is COPE). Jacob Zuma has been the deputy president only because Mbheki had no power to kick him out. Remember in the Parliament people vote for decisions and do you think JZ alone and may be a few would have won against Mbeki and his loyalists “ NO”. This you see the cartoonist last week on Sunday World , they showed a falling building the ANC and Mbheki with the bombs in his pocket, as the building falls he says “ Did I do that ? “ which he successfully did.

The ANC has failed because of their getting into bed with SACP and COSATU who each have differing ideologies, policy platforms, and leadership; – each trying to wrestle control from one another.
In Zuma, the communists have now taken control, and this is a deadly situation for our country, democracy, and the freedoms we ALL have fought for.
COPE represents a clean start without the poison chalice – TO DO WHAT THE ANC CANNOT DO or THAT WHICH THE ANC HAS FAILED TO DO with its so called ‘alliance partners’ pulling its pants down and tripping it up.
Lekota and Shilowa are equally good leaders in their own right otherwise they would not have attained their positions in the ANC government. They are no better or no worse than other good leaders in the ANC. If anything, their ‘supposed’ failure in the ANC (this cannot be said for Shilowa, who is an exceptional leader); – is more of an indictment on the whole of the ANC than themselves as individuals. Perhaps it was the ANC who failed these two (and many others it would seem), and the frustration of working in an environment which was threatening the judiciary, the constitution, and our democracy; – became too much for these brave and honourable leaders. NOTE WELL that Shilowa did not lose his job – HE RESIGNED.
Of course, some of you will never see the light and will continue to raise the ANC shoulder high even when it is a rotting corpse. Such is the inability of ignorant people the world over. You are not alone. Disastrous governments have been created by people from time immemorial.
Clever people, on the other hand, do not pay good money for stale and mouldy ANC cake. They learn from the lessons of history. Clever people know that communism is a failed social experiment, and are not fooled by the innane rhetoric and promises to look after the people. Zakhele or Zakhele the ANC process is two terms and the third term was passed and enforced by Mbheki as the president of the ANC to stay in power. The alliance between the SACP,COSATU and ANC has always been there post the independence so its nothing new. 1. Does JZ’s ANC stand for free and fair elections by actively keeping their supporters away from opposition parties’ meetings?
2. Why do they warn others that they will make certain places no-go areas for opposition campaigners?
3. How can the ANC cadres stand for democracy and threaten violence at every drop of a hat or when someone has a different opinion to their own?
4. Why does the ANC not hold the incumbent ministers and officials accountable for mismanagement and corruption?
5. What are the specific plans that the ANC will implement after nearly 15 years in power to eradicate crime, poverty, poor health, education and housing?
6. What financial levers will the government pull to reallocate resources to make all these things possible bearing in mind that thousands of people in this country will be losing their jobs in the next 12 months because of a worldwide recession?

if the newly ANC executive is led by the Communist Party to me is 100% right because they want to distribute the economy to the community not controlled by certain by individuals whom they recognised themselves as freedom fighters of their friends and family and not the country.
this will definetly work and i 100% correct , is hard time that the wealth must go back to the people and under this new ANC Goverment you will see this happen..
dont take the SACP bad as it only concern about the poor and the gap need to be closed…
